This advertisement is for procuring a contractor to install the Old Falls Street Play Pod in downtown Niagara Falls. The project is located at 102 Old Falls Street on property acquired by USA Niagara through its Strategic Land Acquisition Program. The existing building on the site has been demolished and a new building will soon be constructed on the north portion of the site. Construction on the northern portion will begin in early summer of 2025. The southern portion of the site along Old Falls Street will be developed in the future, but plans have not been finalized. In the interim, USA Niagara will install a semi-permanent fence along the edge of the property to shield the vacant land from view of people walking along Old Falls Street. Additionally, a small public space will be created at the corner of Old Falls Street and First Street that provides shade, seating, games and other amenities. This short-term installation is aimed at activating the space and providing additional amenities on Old Falls Street until a building can be built.
The project components include the following:
- Shade Structure: A fabric shade structure will be installed at the corner of the site.
- Perimeter Fencing: An eight-foot-tall wood privacy fence will be constructed along Old Falls Street. The fence will slope up to 16' at the at the corner of Old Falls Street and First Street. The fence will have undulations that create small areas for along the Old Falls Street face for benches and planters. The taller section at the corner will include tiered bench seating, a repurposed mural and lighting.
- Site Furnishings: Site furnishings will consist of tables, chairs, games and benches. New LED see-saws and swings will also be incorporated.

Work Details
The scope of work includes:
1. Installation of a fabric shade structure at the corner of the site.

3. Provision of site furnishings including tables, chairs, games, benches, LED see-saws, and swings.
4. Mobilization and demobilization of equipment and personnel.
5. Provision of insurance coverage, bonding, and all necessary permits.
6. Installation of play furniture and illuminated play equipment on a multi-layer gravel surface.
7. New electrical service and lighting installation.

Bidder Requirements
The project has a total MWBE participation goal of 30% and a Service-Disabled Veteran-Owned Business contracting goal of 6%. Bidders must demonstrate experience with similar projects completed in the last five years and provide proof of bonding from an A.M. Best rated surety company (minimum A-). Additionally, contractor personnel must have OSHA 10-hour Construction Safety & Health certifications.
