Eligible applicants are limited to jurisdictions that are defined by SORNA as states, the District of Columbia, the principal U.S. territories and federally recognized Indian tribal governments (as determined by the Secretary of the Interior) that are eligible per 34 U.S.C. § 20929 to carry out the functions of SORNA and have elected to do so.For the purposes of this solicitation, "state" means any state of the United States, the District of Columbia, Commonwealth of Puerto Rico, U.S. Virgin Islands, Guam, American Samoa and Commonwealth of the Northern Mariana Islands.Tribal applicants must demonstrate eligibility status by indicating that the tribe has elected to carry out the requirements of SORNA (see 34 U.S.C. § 20911(10)), and has not had its registration duties under SORNA delegated since that election. Tribes that have elected to carry out the requirements of SORNA should submit a tribal resolution that documents the tribe’s election to do so.The SMART Office will prioritize funding to: 1) State and territorial applicants that have already implemented SORNA; 2) Tribal applicants that have implemented SORNA, submitted a SORNA substantial implementation package to the SMART Office for review, or submitted a request for additional time to implement SORNA; 3) Tribal applicants that have not implemented SORNA, but whose SORNA registration activities have not been delegated to the state, if the requested funds will be used to assist the tribe with progressing toward substantial implementation; 4) State applicants who have not implemented SORNA, but whose application request is for activities that will be used to further their efforts to implement SORNA; and 4) Jurisdictions that have not previously received funding under this program.All recipients and subrecipients (including any for-profit organization) must forgo any profit or management fee.
