State Tobacco Retail Compliance Inspection Program

Background
The State of Ohio and the State of Nevada will conduct inspections of retailers that sell regulated tobacco products to determine compliance with the Federal Food, Drug, and Cosmetic Act (FD&C Act), as amended by the Family Smoking Prevention and Tobacco Control Act (TCA), and its implementing regulations found at 21 C.F.R. Part 1140. The contract will be for a twelve (12) month base period and three (3), twelve-month option years beginning FY23.

Work Details
The purpose of this contract is to facilitate the enforcement of the provisions cited in Section C with respect to tobacco retailers, conduct inspections of retailers that sell and advertise any regulated tobacco products to determine compliance with the provisions cited in Section C, collect, document, and preserve evidence of inspections and investigations, support FDA in any enforcement or judicial actions, respond to inquiries by FDA concerning inspections, data, and other information associated with this program.

The Contractor shall assist FDA in implementing the provisions of the FD&C Act, as amended by the Tobacco Control Act, and other applicable statutory and regulatory provisions applicable to retailers during the term of this Contract and any extensions thereto.

Period of Performance
The contract will be for a twelve (12) month base period and three (3), twelve-month option years beginning FY23.

The geographic locations where the inspections will be conducted are listed as follows: OH Base Period, OH Option Period 1, OH Option Period 2, OH Option Period 3, NV Base Period, NV Option Period 1, NV Option Period 2, NV Option Period 3.
