SYNOPSIS OF A PROPOSED COMPETITIVE 8(a) SOLICITATION FOR THE ACQUISITION DETENTION SERVICES, FOOD SERVICES, AND LOCAL TRANSPORTATION AT Buffalo Federal Detention Facility (BFDF) IN BUFFALO, NEW YORK (NY) AREA OF RESPONSIBILITY (AOR)

The United States (U.S.) Department of Homeland Security (DHS), Immigration and Customs Enforcement (ICE) is responsible for the detention, health, welfare, transportation, and deportation of noncitizens in removal proceedings, and those subject to a final order of removal from the U.S. The mission of ICE Enforcement and Removal Operations (ERO) is to identify, arrest, detain and remove aliens, who present a danger to national security or are a risk to public safety, as well as those who enter the U.S. illegally or otherwise undermine the integrity of immigration laws and border control efforts. In implementing its mission, ERO is responsible for carrying out all orders for the securing and departure activities of noncitizens who are designated in removal proceedings and for arranging for the detention of noncitizens when necessary and prescribed by law.

The ERO Buffalo, New York (NY) Field Office has a continued need for comprehensive detention services for approximately 650 adult male and female noncitizens that will provide for general population, intake, segregated housing, and medical beds at the Buffalo Federal Detention Facility (BFDF), a government-owned/contractor-operated detention facility located at 4250 Federal Drive, Batavia, NY 14020. BFDF provides safe and secure conditions of confinement based on the individual characteristics of a diverse population, including threats to the community, risk of flight, type and status of immigration proceeding, community ties, medical and mental health issues. The required contractor management of BFDF shall provide easy access to legal services; ample indoor and outdoor recreation that allows for vigorous aerobic exercise in accordance with PBNDS meal service or satellite feeding; institutional detainee clothing; non-contact and contact visitation, including special arrangements for visiting families, with extended hours including nights and weekends; private areas for attorney-client visits, with video teleconferencing capabilities; noise control; enhanced, but controlled freedom of movement (although the manner and degree of implementation may vary based on security levels); enhanced law library and legal resources; and enhanced programming, including religious services and social programs and dedicated space for religious services.

Detention services shall be performed in accordance with optimal level of the most current version of the ICE Performance-Based National Detention Standards (PBNDS). The most current version is PBNDS 2011 and the 2016 revisions are available at www.ice.gov/detention-standards/2011. The contractor shall also abide by the March 7, 2014, DHS regulation under the Prison Rape Elimination Act of 2003 (PREA; P.L. 108-79) Standards to Prevent, Detect, and Respond to Sexual Abuse and Assault in Confinement Facilities (DHS PREA Standards) available at https://www.ice.gov/detain/prea.

This is a follow-on requirement to contract number HSCEDM-15-D-00002 with Akima Global Services, LLC (AGS). Under this contract, AGS manages and operates the BFDF. The period of performance of this contract currently expires on 01/31/2025.

The procurement will be a competitive 8(a) set-aside. This procurement is expected to award a single award Indefinite Delivery Indefinite Quantity's (IDIQ) with firm-fixed price unit prices and some labor hour CLINs. The IDIQ will have a 10-year period of performance (Year 1 will be inclusive of a 120-day transition). The Service Contract Labor Standards (formerly known as the Service Contract Act of 1965) statute is applicable to this acquisition. All required clauses, provisions and transportation requirements will be identified in the solicitation and resulting contractual instrument.

Note: The solicitation is estimated to be released on Sam.gov no later than August 31, 2024. However, prospective offerors should be aware that the procurement timeline remains subject to change by the government based on mission needs and other factors.

This synopsis does not commit the government to pay, and the government will not pay, any costs or expenses incurred by any prospective offeror in connection with the preparation or submission of an offer, nor does this synopsis commit the government to contract for services or supplies.

This notice does not constitute a request for proposal, request for quote, invitation for bid. The intent of this notice is to provide the pre-solicitation notice required by FAR 5.2, Synopsis of Proposed Contract Actions, in preparation for the release of the Request for Proposal (RFP).

A draft RFP is attached to this synopsis with the intention to allow offerors to begin preparing phase 1 proposals if so inclined. These attachments are drafts and are subject to change.

Background

The ERO Buffalo Field Office has an ongoing requirement for comprehensive detention services at the Buffalo Federal Detention Facility (BFDF) in Batavia, NY, which accommodates approximately 650 adult male and female noncitizens.

Work Details
The contractor will provide management, supervision, labor, and materials necessary to perform detention services at BFDF. Services include:
- Management of general population housing, intake areas, segregated housing, and medical beds.
- Ensuring safe and secure conditions based on individual characteristics of detainees.
- Providing access to legal services and recreation facilities.
- Facilitating visitation rights including special arrangements for families.
- Offering private areas for attorney-client visits with video teleconferencing capabilities.
- Implementing noise control measures and enhanced freedom of movement based on security levels.
- Maintaining an enhanced law library and legal resources.
- Delivering programming including religious services and social programs.

All services must comply with the most current version of ICE Performance-Based National Detention Standards (PBNDS), specifically PBNDS 2011 with 2016 revisions.

Period of Performance
The contract will have a 10-year period of performance with Year 1 inclusive of a 120-day transition period.
