Description

The Commander Fleet Readiness Center (COMFRC) hereby gives notice of their intent to award a Firm Fixed Price Purchase Order to Lynx Software Technologies, Inc., 855 Embedded Way, San Jose, CA on a sole source basis. In accordance with the Federal Acquisition Regulation (FAR) Subpart 6.302-1, only one source reasonably available and no other supplies or services will satisfy agency requirements.

COMFRC requires software license renewal, maintenance, and security patch support for LynxOS 7 Real-Time Operating System. Software patches as they become available. Additionally, telephone and e-mail support is required for the period of performance. This requirement is a follow-on to previously procured Software Maintenance Subscription.

Lynx Software Technologies, Inc. is the designer, developer and original equipment manufacturer (OEM) of the LynxOS 7 software, and retains all the proprietary /technical data rights required in order to perform approved and necessary updates.
Included in the purchase:
- Software License renewal P/N SPMLOSZZZ-PPC700
- Annual Maintenance Subscription
THIS NOTICE OF INTENT IS NOT A REQUEST FOR COMPETITIVE QUOTES. However, all responsible sources may submit a capability statement, which, if received within three (3) calendar days after the date of the publication of this synopsis, will be considered. Information received will be considered solely for the purpose of determining whether to conduct a competitive procurement without impacting the requirement. A determination by the Government not to compete this requirement based upon responses received as a result of this notice is solely within the discretion of the Government.

Background
The Commander Fleet Readiness Center (COMFRC) intends to award a Firm Fixed Price Purchase Order to Lynx Software Technologies, Inc. for software license renewal, maintenance, and security patch support for the LynxOS 7 Real-Time Operating System. This contract is based on a sole source justification as only one source is reasonably available to meet the agency's requirements. Lynx Software Technologies, Inc. is the original equipment manufacturer (OEM) of the LynxOS 7 software and holds all proprietary rights necessary for updates.

Work Details
The contractor is required to provide the following services:
- Renewal of software license P/N SPMLOSZZZ-PPC700.
- Annual maintenance subscription including access to new software releases, revisions, and patches as developed during the period of performance.
- Delivery of new license files for any new software version releases via email or downloadable from the vendor's website.
- Telephonic technical support and email support from Monday to Friday (excluding Public Holidays) between 09:30 hrs. and 17:00 PST for issues related to software configuration, bugs, or licensing problems.

The contractor will not create or implement customized changes to the software.

Period of Performance
The service shall commence on the effective date of purchase order and continue for one year.

Place of Performance
Services will be performed remotely with support accessible via email and phone.
