The U.S. Army Contracting Command - Aberdeen Proving Ground (ACC-APG), Natick Contracting Division (NCD) on behalf of Product Manager Force Sustainment Systems (PdM FSS), located at the Natick Soldier Systems Center intends to negotiate a contract modification on a sole source basis in order to extend the production ordering period by two (2) years for the MTRCS design, development and manufacturing contract that was competitively awarded on 27 June 2016 with a five (5) year ordering period.

PdM FSS has a requirement for the MTRCS ordering period to be extended by two (2) years under the existing firm fixed price IDIQ contract W911QY-16-D-0042 IAW DFARS 217.204(e)(1) which provides the DoD the authority to extend IDIQ contracts beyond five years. The Army requirement is to have a contract vehicle in place to procure MTRCS, components, spare parts and associated equipment under the authority of 10 U.S.C. 2304(c)(1), as implemented by FAR 6.302-1, Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements.

This contract modification will allow Berg Manufacturing, Inc. (Berg) to manufacture additional MTRCS production units and perform a series of production support activities in order to fulfill the original terms of the IDIQ contract. The production support activities include contractor travel, storage of production units, performance of storage maintenance tests, production of spare parts kits, shipment of production units, delivery of a technical data package to document the production configuration, manufacture of shipping containers for MTRCS refrigeration units, and the performance of contractor logistics and technical support. The contract modification allows Berg to make revisions or improvements to the Operator Technical Manual (TM), Field Level Maintenance TM, National Maintenance Work Instruction manual, packaging products, operator and maintainer training packages, engineering data for provisioning, and the interactive multimedia instructional package. The required ordering period extension is based off of a contract that was competitively awarded as a 100% Small Business Set-Aside. The North American Industry Classification System (NAICS) Code is 333415, and the size standard is 1,200 employees. This is a notice of intent and is not a request for competitive quotations or proposals.

Due to the specifics identified herein Berg is the only known source currently capable of producing the potential limited production quantities of MTRCS over the next two (2) years without duplicating costs and causing delays in product availability. However, all responsible sources may submit a capability statement, which shall be considered by the agency. Any response to this notice must show clear and convincing evidence that competition would be advantageous to the Government. If no affirmative written response is received by 12:00 p.m. EDT on 4 June 2021, the contract extension modification will be issued without further notice. A determination by the Government not to compete this ordering period extension requirement is based on this notice and is solely within the discretion of the Government.
