This is solicitation is for a non-personal services Master Blanket Purchase Agreement (BPA) to provide recurring court reporting and transcription services (electronic) for various legal processes applicable to Aberdeen Proving Gound, Maryland. The submission of the documentation specified below will constitute the offeror's acceptance of the terms and conditions of the solicitation, and concurrence with the contract type. 52.212-2 EVALUATION--COMMERCIAL PRODUCTS AND COMMERCIAL SERVICES (NOV 2021) The Government will award a Master Blanket Purchase Order (BPA) resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered. The following factors shall be used to evaluate offers: The contract will be awarded to the Lowest Price Technically Acceptable (LPTA) offeror. The award will be made on the basis of the lowest evaluated price of quotations meeting or exceeding the acceptability standards for non-cost factors, which are the technical requirements in accordance with the Performance Work Statement. The technical evaluation will be a determination based on information furnished by the offeror. The Government is not responsible for locating or securing any information which is not identified in the quotation. The following factors shall be used to evaluate offers: Lowest Price Technically Acceptable: Technical Offerors shall clearly articulate the technical approach (including risks and contingencies) for performing the work, an understanding of the requirement and the capacity to perform the work. Offeror shall not "parrot" the Performance Work Statement (PWS). Offeror shall include QUALITY CONTROL PLAN and/or MANAGEMENT PLAN within the quote proposal that illustrates the contractor's capability to perform/provide services in accordance with the PWS, specifically paragraph 3.6 Personnel and Qualifications. Technical will be rated using the adjectival rating of Acceptable/Unacceptable rating, Technical Acceptable/Unacceptable Ratings: ACCEPTABLE - Proposal meets the requirements of the solicitation. UNACCEPTABLE - Proposal does not meet the requirements of the solicitation or provides any understanding of the requirement. The proposal contains a combination of weakness that causes an unacceptable level of risk of unsuccessful performance and is un-awardable. Technical will be evaluated to determine if the proposed approach meets or does not meet the minimum performance or capability requirements. To receive an "ACCEPTABLE" Technical rating, the proposal must illustrate the contractors ability to perform and provide services in accordance with the PWS. Offerors that are rated "UNACCEPTABLE" for the Technical will not be considered for award. Past performance shall be evaluated. The offeror shall provide relevant and recent Court Reporting services as outlined in the PWS over the past four (4) years. Offeror shall provide, at a minimum, three prior or current contracts that demonstrates they have the relevant and recent experience in providing similar services within the last 4 years. See adjectival rating metrics for past performance below: ACCEPTABLE - Based on the offeror's performance record, the Government has a reasonable expectation that the offeror will successfully perform the required effort, or the Offeror's performance record is unknown. NEUTRAL - No recent/relevant performance record is available, or the offeror's performance record is so sparse that no meaningful confidence assessment rating can be reasonably assigned. The offeror may not be evaluated favorably or unfavorably on the factor of past performance. UNACCEPTABLE - Based on the Offeror's performance record, the Government does not have a reasonable expectation that the Offeror will be able to successfully perform the required effort. The Government will focus its inquiries on the offeror's record of performance as it relates to all solicitation requirements, including cost, schedule, and performance. A significant achievement, problem, or lack of relevant data in any element of the work can become an important consideration in the evaluation process. Therefore, offerors will be reminded they must at a minimum include the most recent and relevant efforts (performance within the past four years) in their proposal. Absent any recent and relevant past performance history or those for whom information on past performance is not available, the offeror may not be evaluated favorably or unfavorably on past performance. In some circumstances Past Performance may receive a neutral rating. Therefore, when a neutral rating is assigned, it shall be assumed that the offeror will perform in an acceptable manner. Price. Price proposal shall be completed on the SF 1449 for all CLINs. Pricing shall reflect the unit of issue in accordance with CLIN structure. The Government will make no assumptions. Award will be made to the offeror who provides the best value for the Government on the basis of lowest price, technically acceptable and 4 years of prior experience performing this type of servce. (b) Options. The Government will evaluate offers for award purposes by adding the total price for all options to the total price for the basic requirement. The Government may determine that an offer is unacceptable if the option prices are significantly unbalanced. Evaluation of options shall not obligate the Government to exercise the option(s). (c) A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer's specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.
