Contractor Questions for RFP W56HZV-19-R-0005 (RA-1 Parachute System Items)

1. Could you clarify Production time allowed for Products with FAT? 150 Days with FAT

Using the following assumptions:

Section I - 102 FAR 52.209-3 First 90 days (30 Day notification to US GOV for Test Date and Production.)

After the First Article Test US GOV can take up to 45 Days to Approve.

90 Days + 45 Days = 135

Leaves 15 Days for production of the product, inspection and delivery.

Are the above assumptions correct?

Government Response: For those items with a 150 day delivery schedule with FAT, the breakdown is as follows: 60 days for FAT report, 30 days for Government approval/disapproval, then 60 days for first production delivery. 210 days including FAT would be: 60 days for FAT report, 30 days for Govt approval/disapproval, then 120 days for first production delivery. 240 days including FAT would be: 60 days for FAT report, 30 days for Govt approval/disapproval, then 150 days for first production delivery.

Clause 52.209-3 should say 30 days for Government approval/disapproval. Amendment 0001 to the solicitation has been issued to correct this.

2. Section E.5 Notice Regarding First Article Test Sample & Section B - Item No. 16

Section E.5 states two FAT that will be consumed or destroyed in testing - should not be delivered as part of the contractual quantity.

However Section B - Item No. 0016 states that First Articles should be retained as Manufacturing Standard and shall be submitted as part of the final production delivery.

If First Articles are destroyed during testing then do we need to produce additional First Articles for Delivery?

Are the two First Articles that are required (by contract) included in the product quantity stated for the 1st Year? Or are they additional?

Government Response: If First Articles are destroyed during testing, you do not need to produce additional First Articles for Delivery. Yes, except for the D-Bag (NSN: 1670-01-623-5865), the two First Articles that are required (by contract) and not consumed or destroyed in testing can be included in the product quantity stated for the 1st Year. The first paragraph of Section E.5 and the narrative under CLIN 0016 have been revised via Amendment 0001.

3. Section B - Item No. 0016 First Article Test & Report is listed as NSP (Not Separate Pricing), however the attachment 1 (Product List) has a separate space for the First Article Test Price.

Should Section B - Item No. 0011 include the FAT within the pricing?

Government Response: If FAT is not waived for an item, the FAT price will be added/incorporated into the total cost for that particular item on Delivery Order One.

4. Have any other questions been asked and answered? If yes, will all questions and answers be circulated to all respondents to ensure complete information is disseminated?

Government Response: As of 29 July 2019, no other questions have been asked. All questions and answers posed by contractors will be posted to FBO.

5. It is noted that TDPL Report #20180432 has a Distribution Statement A - Approved for public release distribution is unlimited. However, the TDP is restricted. Are we required to sign an NDA to obtain the TDP? If yes, please provide.

Government Response: TDPL Request Number #201803432 for TDPL 11-1-9107 has Distributions of A and C. The contractor is not required to sign a NDA to obtain the Distribution C portion of the TDP. If the contractor requires the Distribution C portion of the TDP, please let me know.

6. Is the Year 1 Lot $ value (CLIN 0011) minimum quantity for year 1, or is it the total maximum quantity for 5 years? Will there be multiple orders in year 1 after the minimum order?

Government Response: The Minimum Guaranteed Quantity for each item as specified in column G of tab one, Attachment 0001 will be ordered via Delivery Order One in the First Ordering Year. The Maximum Contract Quantity (Years 1 - 5) specified in column H of tab one, Attachment 0001 includes the Minimum Guaranteed Quantity specified in the column G. At this time, it is unknown whether there will be multiple orders in the First Ordering Year beyond the Minimum Guaranteed Quantity ordered via Delivery Order One.

7. Attachment 1 - Product List

Column Headings:

- Delivery Order One, Qty/Minimum, Guaranteed Contract Qty

- Delivery Schedule with (and without) FAT

The delivery schedule, as stated, creates a very cyclical production schedule of ordering materials, continuous production for well over 50 workers for just two to four months with a severe drop-off thereafter. This type of production is very damaging and unsustainable for any organization interested in the training and development of a strong workforce with the desire to maintain a high level of skill with a continuous, well-planned level of work. With respect, will the government reconsider this delivery schedule to allow sufficient time for ordering material, ramp-up and full-rate production of these items? We are happy to assist with this process as required.

Government Response: In accordance with Clause 52.211-8 (Time of Delivery), the contractor may propose an alternate delivery schedule for each item.

8. If the supply chain is unable to supply materials within the scheduled delivery, would a contract delivery modification be considered?

Government Response: Contract modifications will be considered by the Government on a case-by-case basis. However, the contractor is contractually obligated to perform in accordance with the stated delivery schedule in Section B of the contract.
