Description

This notice is being published in accordance with Federal Acquisition Regulation (FAR) Section 5.101 requiring dissemination of information for proposed contract actions. This is a notice of intent to award a sole source contract, and is not a request for competitive quotes or proposals.

The Commodity Futures Trading Commission (CFTC) intends to negotiate and award a sole-source contract for the procurement of a direct fiber connection between the CFTC data network (as currently hosted by Recovery Point Systems, Inc.) and the CFTC Amazon Web Services (AWS) datacenter. CFTC intends to award a contract with one base year and four option years, for a total period of performance of five (5) years.

Through a competitively awarded GSA FSS task order, Recovery Point Systems, Inc currently provides an offsite Information Technology (IT) facility to host CFTC critical IT systems. This facility is located in Maryland. CFTC has a continued need for a direct fiber connection between this offsite facility and the AWS data center in Ashburn, VA as well as the Recovery Point CoreSite data center located in Reston, VA. Only Recovery Point Systems, Inc can provide this direct fiber connection between the described locations as it is the owner of the origination point for the direct fiber line (the offsite critical IT systems facility).

CFTC knows of no alternative source that can provide a direct fiber connection between the CFTC data network and the CFTC Amazon Web Services (AWS) datacenter.

The Government intends to procure this requirement under FAR 6.302-1(a) and 41 U.S.C 3304(a)(1) - "Only one responsible source and no other supplies or services will satisfy agency requirements." This notice does not constitute a solicitation for offers and, as such, no solicitation is available. However, the Government will consider responses from all responsible sources received by 5:00pm ET, May 29, 2024. Written responses must include sufficient information to establish capability to fulfill the requirement. A determination by the government not to compete this proposed requirement is solely within the discretion of the Government. Any responses received will only be considered for the purpose of determining whether to conduct a competitive procurement in lieu of the sole source described in this notice. The Government anticipates award on or about July 15, 2024. The Government will not be responsible for any costs of preparation in response to this announcement.
